Initial Determination of Spousal Support

We only recommend going to trial on spousal support issues when we believe that you will receive a more just result from the court than what your spouse has offered to you in his or her settlement proposals.
When determining whether to award support to a spouse, and if so, what amount, the court looks at several factors, such as, (1) the length of the marriage; (2) other resources of income for the payee spouse; (3) ability of the payee spouse to earn income; (4) marital fault, such as waste of assets or adultery; (5) and the age and health condition of the payee spouse.
